The former personal attorney for Donald Trump has stepped down as the chief federal prosecutor in the state. This comes after a judicial decision that questioned her right to occupy the role.
Acceptance of Resignation
The head of the Justice Department, Pam Bondi, accepted her stepping down on the start of the week. She commented that the court's "flawed" ruling made it "untenable" for her to perform her duties.
"Let no one confuse adherence to the ruling as defeat," she declared. "This battle will now reach across America."
Judicial Challenge
The departure comes a week after a judicial panel ruled that she had been unlawfully serving as the top prosecutor. This judgment is could influence scores of prosecutions in New Jersey.
The court declared that a interim role that bypassed the advice and consent of the Senate violated the Federal Vacancies Reform Act.
Ongoing Legal Battle
It was also stated that the former prosecutor will remain at the DOJ as a top consultant. They intend to challenge the decision of the disqualification, in the hope of achieving a different outcome.
Writing online, the Attorney General argued that judges "cannot be permitted to countermand the President's choice of prosecutors entrusted with performing the primary duty of the administration of prosecuting crime."

Bondi commended the prosecutor's work and said that under her leadership, the Newark saw a significant drop in offenses. She also stated that the southern city of Camden recorded its first summer in 50 years without a homicide.
Connection to Donald Trump
Habba, 41, was initially recruited to Donald Trump's lawyers in recent years. Subsequently, she represented the former president in his business records case in 2024, leading to his guilty verdict on dozens of charges of document fraud.
Prior to Habba took on the top New Jersey post, Trump had stated he was appointing her as his presidential counsellor in a potential future term, calling the lawyer as a steadfast ally and a "tireless advocate for justice".
